City code for ATV use won't be amended
After looking at an issue referred to them by the city council, the Lake Elmo Planning Commission voted to send the issue back.
At their July 28 meeting, the planning commission voted 5-3 to send an issue concerning the use of motorized recreational vehicles back to the city council with a recommendation that the city council make no changes to the current ordinance.
At the city council's July 1 meeting, a resident asked the city to amend its ordinance regarding ATVs, snowmobiles and other motorized recreational vehicles.
The resident asked that the city only allow use of those vehicles on property greater than 5-acres in size, change the permitted hours of use from the present 7 a.m. to 11 p.m. to 10 a.m. to 5 p.m. and prohibit the use within 150 feet of any property line.
Most planning commissioners were uncomfortable with several aspects of the request. In addition, planning commissioners didn't like the idea of allowing larger property owners more rights than smaller property owners.
Planning commissioners also noted that the city already amended the ordinance dealing with motorized recreational vehicles earlier this year and saw no reason to change it again.
