NOTICE OF PUBLIC HEARING

NOTICE OF PUBLIC HEARING ON A MINOR SUBDIVISION; A VARIANCE TO THE 1.5-ACRE MINIMUM LOT AREA REQUIREMENT; AND VACATION AND DISCONTINUANCE OF CERTAIN PUBLIC DRAINAGE AND UTILITY EASEMENTS AT 6425 PRESERVE PASS AND 6350 PRESERVE PASS

NOTICE IS HEREBY GIVEN that Genstar Land Company Midwest, LLC has applied for a minor subdivision to subdivide approximately .34 acres of land from 6425 Preserve Pass and add it

to 6350 Preserve Pass and a variance to the 1.5-acre minimum lot area requirement to allow the lot area at 6425 Preserve Pass to decrease from 1.67 acres to 1.33 acres; and to vacate and discontinue certain drainage and utility easements dedicated to the City of Cottage Grove legally described as follows:

That part of the drainage and utility easement as dedicated on Lots 27 and 28, Block 3, Homestead at Highland Hills, according to the recorded plat thereof, Washington County, Minnesota, described as follows:

Commencing at the northeast corner of said Lot 28, Block 3; thence North 89 degrees 22 minutes 20 seconds West, assumed bearing, along the north line of said Lot 28, a distance of 226.83 feet to

the westerly line of Pipeline Easement per Document No. 3044882; thence South 04 degrees 15 minutes 00 seconds East, along said westerly line a distance of 65.00 feet to the actual point of beginning of the drainage and utility easement to be vacated; thence South 04 degrees 15 minutes 00 seconds East, continuing along said westerly line, a distance of 96.59 feet; thence South 03 degrees 46 minutes 02 seconds West, continuing along said westerly line, a distance of 58.52 feet to the existing easement line distant 15.00 feet and parallel to the easterly line of said Lot 27 as dedicated on said plat of Homestead at Highland Hills, thence North 25 degrees 29 minutes 00 seconds West, along said parallel line, a distance of 233.24 feet to the existing easement line distant 10.00

feet and parallel to said north line of Lot 27 as dedicated on said plat of Homestead at Highland Hills; thence South 89 degrees 22 minutes 20 seconds East, along said parallel line, a distance of 50.69 feet; thence South 39 degrees 58 minutes 51 seconds East, a distance of 72.14 feet to the point of beginning. Said public drainage and utility easements are part of real estate property generally known as 6425 Preserve Pass and 6350 Preserve Pass, Cottage Grove, Minnesota.

The City Council for the City of Cottage Grove, Minnesota, will meet in the Council Chambers at City Hall, 7516 - 80th Street South, Cottage Grove, Minnesota, on Wednesday, February 18, 2009, at 7:30 p.m.

The purpose of the hearing is to provide citizens the opportunity to comment on the proposed application. Persons interested in speaking will be heard at this public hearing. If you are unable to attend the hearing but would like to provide input, you are encouraged to submit written comments. Written or oral comments received will be entered into public record. Information on this application can be obtained from the Community Development Department at Cottage Grove City Hall.
