NOTICE OF HEARING
ON PROPOSED ASSESSMENTS
ST. PAUL PARK,
NOTICE IS HEREBY GIVEN, that the City Council of the City of St. Paul Park, Minnesota, will meet at 7:00 p.m. on May 4, 2009, in the Council Chambers of the City Hall, 600 Portland Avenue, St. Paul Park, Minnesota, to pass upon the proposed assessments for the following improvements:
Sanitary sewer, watermain, storm sewer, street reconstruction and sidewalk in the following streets:
• Pullman Avenue from 5th Street to the east City limits
• Aurora Avenue from Eleventh Avenue to Pullman Avenue
• McCammon Avenue from Eleventh Avenue to Pullman Avenue
• Marshall Avenue from Eleventh Avenue to Pullman Avenue
• Dayton Avenue from Eleventh Avenue to Pullman Avenue
• Selby Avenue from Eleventh Avenue to Pullman Avenue
• Laurel Avenue from Ninth Avenue to Pullman Avenue
• Ashland Avenue from Tenth Avenue to Pullman Avenue
• Tenth Avenue from Holley Avenue to Lincoln Avenue
• Eleventh Avenue from Holley Avenue to Lincoln Avenue
• Sidewalk along Pullman Avenue from Chicago Avenue to 5th Street.
The total cost of the entire project is the sum of $2,582,995.32 of which $459,361.53 is the sum proposed to be assessed against the benefited properties, which are those properties abutting the streets above described, all within the City of St. Paul Park, Minnesota. The proposed assessment roll is on file for public inspection at the office of the City Clerk. Written and oral objections will be considered at the above hearing.
No appeal may be taken as to the amount of any assessment adopted by the City Council at the above hearing unless a written objection is signed by the affected property owner and filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at said hearing. Any owner aggrieved by the adoption of any assessment adopted at the above hearing, may appeal to the District Court of Washington County, Minnesota, pursuant to Minnesota Statutes Annotated, Section 429.081, by serving a notice of appeal upon the Mayor or Clerk of the City of St. Paul Park within thirty (30) days after the adoption of the assessment, and by filing such Notice and proof of such service with the Clerk of District Court, Washington County, Minnesota, within ten (10) days after said service upon the Mayor or Clerk.
Property owners are further advised that Minnesota Statutes Annotated, Sections 435.193 to 435.195 grant the City of St. Paul Park the authority to enact an ordinance deferring payment on any assessment levied by the City against homestead property owned by a person of 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments. These sections further provide for a procedure whereby any qualified homeowner may make application for deferral of payment of any such assessments. A copy of Minnesota Statutes Annotated, Section 435.193 to 435.195 is on file in the office of the City Clerk and available for inspection by the public.
