In the Matter of Whitson Endowment Fund
IT IS ORDERED that the Petition of Dianne S. Polasik, in her capacity as co-trustee of the Dorothy N. Whitson Revocable Trust (hereinafter, "Trustee"), and Independent School District No. 834, in its capacity as a charitable beneficiary of the Dorothy N. Whitson Revocable Trust (the "Trust"), filed on May 19, 2014, regarding the modification of a charitable trust for the benefit of Independent School District No. 834, be heard before this Court on Friday, July 11, 2014, at 9 o\'clock a.m., at Washington County Courthouse, 14949 62nd Street North, Stillwater, Minnesota 55082, and that all interested persons may then and there be heard.
The Petition seeks an Order of this Court:
1. Confirming that the Trust is imperfectly expressed with respect to the administration of the Whitson Endowment Fund for the benefit of Petitioner I.S.D. 834 for the Early Childhood Family Center.
2. Confirming that I.S.D. 834 is the sole beneficiary of the charitable trust granted pursuant to Subsection (h) of Section 10; and Subparagraph (iv) of Subsection (n) of Section 10 of the First Amendment to Second Complete Restatement of Dorothy N. Whitson 1988 Revocable Trust Agreement for establishment of the Lee and Dorothy Whitson Endowment Fund for the Early Childhood Family Center.
3. Directing Petitioner I.S.D. 834 to transfer the Whitson Endowment Fund to the St. Croix Valley Foundation in order to perfect administration of the Whitsons\' charitable intent.
4. Directing the St. Croix Valley Foundation to hold and administer the Whitson Endowment Fund as charitable trustee in an endowment for the sole continuing benefit of I.S.D. 834 for the Early Childhood Family Center.
IT IS FURTHER ORDERED that notice of such hearing shall be given pursuant to Minn. Stat. § 501B.18.
