Minimum wage rates to be paid by the Contractors have been predetermined and are subject to the Work Hours Act of 1962, P.L. 87-581 and implementing regulations.
READ CAREFULLY THE WAGE SCALES AND DIVISION A OF THE SPECIAL PROVISIONS AS THEY AFFECT THIS/THESE PROJECT/ PROJECTS
The Minnesota Department of Transportation hereby notifies all bidders:
in accordance with Title VI of the Civil Rights Act of 1964 (Act), as amended and Title 49, Code of Federal Regulations, Subtitle A Part 21, Non-discrimination in Federally-assisted programs of the Department of Transportation, it will affirmatively assure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded maximum opportunity to participate and/or to submit bids in response to this invitation, and will not be discriminated against on the grounds of race, color, disability, age, religion, sex or national origin in consideration for an award;

"It is hereby agreed between the parties that this agency will require affirmative action requirements be met by contractors in relation to Minnesota Statute 363A.36 and Minnesota Rules 5000.3600. Failure by a contractor to implement an affirmative action plan or make a good faith effort shall result in revocation of its certificate or revocation of the contract (Minnesota Statute 363A.36, Subd. 2 and 3)."
A minimum goal of 9.7% Good Faith Effort to be subcontracted to Disadvantaged Business Enterprises.
Said Construction generally consists of Urban Street Reconstruction, Pond Excavation, Installation of Storm Sewer Drainage Structures and Piping, Permanent Erosion Stabilization, and associated work. The work includes the following approximate quantities of work:

Building Removal - 1.0 LS
Common Excavation - 72,000 CY
Topsoil Borrow- 3,500 CY
Composite Pond Liner - 2,200 SY
Aggregate Base - 1,500 TON
Bituminous Pavement - 800 TON
Concrete Curb and Gutter - 1,600 LF
Storm Sewer Pipe - 5,000 LF
Drainage Structures - 48 EA
Rip Rap - 1200 CY
Erosion Stabilization Mat Class 4 (Permanent) - 7,500 SY
Erosion Control Blanket Category 2 - 56,000 SY
Chain Link Fence - 1,500 LF

The advertisement for the bid package will also be placed in the following locations: Finance & Commerce legal ledger once per week for two weeks (December 14th, January 4th), the South Washington County Bulletin once on December 14th, and the MnDOT StateAid EAdvert website at www.dot.state.mn.us/stateaid/sa_eadvert.html December 14th through the bid date.
Each bid must be accompanied by a bid bond, cashier's check or a certified check payable to the City of Newport, Minnesota, for at least five (5) percent of the amount of the bid, which amount shall be forfeited to the City of Newport, Minnesota, as liquidated damages if the bidder, upon the letting of the contract to them shall fail to enter into the contract so let; the City Council reserving the right to reject any and all bids.
A Performance and Payment Bond, as required by the Contract, by a surety company authorized to do business in the State of Minnesota will be required with the contract. (Personal bonds will not be accepted.)
